Effective date: 1 August 2026 Version: 3.0 Supersedes: the Arteriya User Agreement v2.0 of 27 July 2026, and all previously published Terms of Service, Content Policy and Copyright Policy.

These Terms govern your use of Arteriya. They are offered as a public offer under Article 11 of the Law of Ukraine "On Electronic Commerce" (№ 675-VIII).

Two further documents form part of the agreement between us:

• the Privacy Policy — what personal data we process, why, and what you can do about it, including cookies and our use of machine learning;
• the Operator details page — the statutory identification of the operator.

Together these three documents replace the single User Agreement published on 27 July 2026. Nothing of substance was removed in the split; the material was separated so that the privacy notice stands on its own, as a privacy notice should.

1. Who we are

Arteriya is a professional network for creative practitioners — photographers, models, make-up artists, stylists, retouchers, creative directors and others who work together on creative projects.

The service is operated by a private entrepreneur registered in Ukraine.

Those identification details are published in accordance with Article 7 of the Law of Ukraine "On Electronic Commerce" (№ 675-VIII) and Article 56(11) of the Law of Ukraine "On Copyright and Related Rights" (№ 2811-IX). They are held on a separate page rather than reproduced here; that page is publicly accessible, requires no registration, and is one click from this section, so the information is available to you before you accept these Terms.

In these Terms, "we", "us" and "our" mean the operator identified there. "You" and "your" mean you as a user of Arteriya. "Content" means anything you upload, post or send through the service — principally photographs, but also profile text, project descriptions and messages.

2. How you accept these Terms

You accept these Terms, and the Privacy Policy they incorporate, by ticking the acceptance box during registration and pressing the registration button. Under Article 11(6) of the Law of Ukraine "On Electronic Commerce", this constitutes acceptance by conclusive action, and the contract between us is concluded at that moment.

We record, for each acceptance: your user identifier, the date and time, your IP address, and the version of these Terms you accepted. We keep an archive of every published version so that it is always possible to establish which text you agreed to.

If you do not accept these Terms, do not register and do not use Arteriya.

Where we make a change that materially affects your rights or the licence you grant us, we will ask you to accept the new version. Content you uploaded under an earlier version remains governed by the version in force when you uploaded it, unless you accept the new one.

3. Who may use Arteriya

3.1 Minimum age

You must be at least 18 years old. Arteriya is a professional service for working adults. It involves adult content, in-person engagements between users, and financial arrangements. We do not knowingly permit anyone under 18 to hold an account.

If we learn that an account belongs to someone under 18, we will terminate it and delete the associated content. If you believe a minor is using Arteriya, tell us at abuse@arteriya.pro.

3.2 Geographic availability

Arteriya is currently available only to users located in Ukraine. During this closed alpha we decline registrations from outside Ukraine. We determine your location by IP geolocation at registration and at sign-in.

We will announce it here before we open the service to users in the European Union, the United States or elsewhere, and we will publish the additional information those jurisdictions require before doing so.

You may not use Arteriya if you are located in, ordinarily resident in, or a national of a jurisdiction subject to comprehensive international sanctions, or if you appear on any applicable restricted-party list.

3.3 Your account

You are responsible for your account and for everything done through it. Authentication is provided by Google Firebase Authentication; keep your credentials secure and tell us promptly if you believe your account has been compromised.

One person, one account. Do not impersonate anyone, do not sell or transfer your account, and do not create an account on behalf of someone else without their authority.

4. Your content and the licence you grant us

4.1 You keep ownership

You retain all rights in your content. We claim no ownership of your photographs or any other work you upload. Nothing in these Terms transfers copyright to us.

4.2 Your moral rights are untouched

Under Article 11 of the Law of Ukraine "On Copyright and Related Rights", an author's personal non-property rights belong only to the author and cannot be transferred. We do not ask you to waive them and any purported waiver would be void. You remain entitled to be recognised as the author of your work, to have your name shown or withheld, and to object to distortion of your work that prejudices your honour or reputation.

Because the service necessarily processes your images, you consent to the following specific technical acts, which we could not otherwise perform: resizing and re-encoding into our display formats; generating thumbnails, previews and low-resolution placeholders; embedding an invisible provenance watermark; applying a blur overlay where our content rules require it; and displaying your work in grid, search and recommendation layouts where your name may not appear alongside every thumbnail.

4.3 The licence you grant us

To operate Arteriya we need your permission to use your content. You grant us a licence on the following terms:

• Type: non-exclusive. You remain free to use and license your work however you wish, to anyone, at any time.
• Payment: the licence is granted free of charge. We owe you no royalty and you owe us no fee for it.
• Territory: worldwide, without territorial restriction, because the service is delivered over the internet.
• Term: for as long as your content is on Arteriya, plus 90 days after you delete it, to allow for the expiry of caches, content-delivery copies and routine backups.
• Permitted uses. We may only use your content in the ways listed here:
  1. reproduction and storage in electronic form;
  2. making available to the public over the internet within the service;
  3. public display within the service;
  4. adaptation strictly to the extent necessary to deliver the service — resizing, re-encoding, thumbnailing, cropping for layout, blur placeholders, invisible watermarking;
  5. inclusion in our search indexes, recommendation systems and similarity indexes, including the generation of numerical embeddings, captions and tags as described in section 11 of the Privacy Policy;
  6. sub-licensing solely to our hosting, storage and content-delivery providers to the extent needed to store and deliver your content to other users.

We will not use your content for advertising outside Arteriya, will not sell or license it to third parties, and will not use it to train generative image or text models. See section 11.3 of the Privacy Policy.

4.4 Public showcase

If your work is set to published, we may feature it on public, signed-out pages of Arteriya — the home page and the public showcase. Content that our moderation systems have flagged as adult is excluded from these surfaces. You can prevent showcase use by setting your images or profile to a non-public state.

4.5 Your warranties about content

You warrant, each time you upload, that:

• you are the author of the content, or hold all rights necessary to grant the licence in section 4.3;
• the content does not infringe anyone's copyright, trademark, or other rights;
• the content complies with section 6;
• you hold the consents required by section 5 from every identifiable person depicted.

4.6 Text and data mining

We reserve all rights in respect of text and data mining of content on Arteriya, in accordance with Article 4(3) of Directive (EU) 2019/790 and equivalent provisions. We signal this reservation in machine-readable form (robots directives, response headers, and rights metadata retained in image files). This reservation is made on your behalf as well as ours.

5. People depicted in your images

This section matters more than any other for photographers, and Ukrainian law here is not what most people assume.

5.1 The legal position

Under Article 307 of the Civil Code of Ukraine, a person may be photographed only with their consent — though consent is presumed where filming takes place openly in the street or at a public event.

Under Article 308 of the Civil Code of Ukraine, a photograph depicting a person may be publicly displayed, reproduced or distributed only with that person's consent. There is no public-place exception to publication. Consent to be photographed is not consent to be published.

There is one important exception: where the person posed for the author for payment, the photograph may be publicly displayed, reproduced and distributed without further consent.

Publishing an old photograph today is a fresh act of distribution requiring consent today. The date of the shoot does not matter; the date of publication does. If you are uploading a back catalogue, this applies to every image in it.

5.2 What we require of you

For every image showing an identifiable person, you must confirm at upload that you hold that person's consent to publish the image on Arteriya. We record this attestation with a timestamp against the image.

You warrant that:

• every identifiable person depicted has consented to publication of that image on Arteriya, or posed for you for payment within the meaning of Article 308(2);
• every identifiable person depicted was at least 18 years old when the image was made;
• for any image containing nudity or intimate content, you hold that person's specific, written consent to publication of that image, and you can produce it on request;
• where an image credit names a real person, you hold their consent to the use of their name (Article 296 of the Civil Code of Ukraine).

We may ask you to produce evidence of consent. If you cannot, we will remove the image.

You will indemnify us against any claim brought by a person depicted in content you uploaded.

5.3 If you are depicted in an image

If you appear in an image on Arteriya, you may ask us to remove it — whether or not you have an account. Write to privacy@arteriya.pro identifying the image and confirming that you are the person depicted.

We will remove the image without requiring you to prove the absence of consent and without adjudicating between you and the uploader. This right exists independently of the uploader's wishes.

You also have the data-protection rights in section 9 of the Privacy Policy, including the right to object to and to obtain erasure of personal data about you, even though you are not a user.

6. Content rules

6.1 What Arteriya is for

Arteriya is for professional creative work made by human beings: photography, styling, make-up artistry, retouching, and the collaborative projects that produce it.

6.2 Adult content — permitted, with restrictions

Art has always engaged with the body, and we do not intend to exclude it. Artistic nudity is permitted where the nudity sits in a clear artistic, aesthetic or editorial context. So is staged, clearly fictional depiction of violence in a narrative or conceptual work.

Because the boundary is contextual, every image our systems flag is assessed individually.

Adult content on Arteriya is subject to all of the following:

• it is blurred by default for every user;
• it is never shown on public, signed-out pages, including the home page, the public showcase, and social preview images;
• it is shown only to users who have completed age and identity verification;
• it is never monetised — we do not sell access to it, do not place it behind a paid tier, and do not share revenue on it.

6.3 Prohibited content

The following must never be uploaded to Arteriya.

Absolutely prohibited — reported to the authorities:

• Child sexual abuse material, and any sexualised depiction of a minor. We report this to law enforcement, preserve it under a documented process for the period the authorities require, and terminate the account without notice. We do not retain it for any other purpose.

• Non-consensual intimate imagery, including synthetic or manipulated imagery of a real person ("digital forgeries"). See section 9.

• Content prohibited under martial law. Ukraine is under martial law. Article 114-2 of the Criminal Code of Ukraine makes it an offence to disseminate information about the movement, transfer or location of the Armed Forces of Ukraine or other military formations where the location can be identified on the terrain, unless already published by an authorised state body. Do not upload images depicting military personnel, equipment, positions, air-defence assets, defence-industry facilities, critical infrastructure, or the identifiable location of strike damage. You are personally liable under Article 114-2; the penalties are severe.

  ⚠️ Note carefully: photographs commonly contain GPS coordinates in their embedded metadata. See section 6 of the Privacy Policy — read it before uploading anything shot near a sensitive location.

Also prohibited:

• Pornography. Vulgar, naturalistic or explicit depiction of sexual acts, self-cited display of genitalia, or content whose evident purpose is sexual arousal rather than artistic expression. Distribution of pornographic material is a criminal offence in Ukraine under Article 301 of the Criminal Code. We do not permit it, and we do not accept the risk.

• Real violence and cruelty — graphic imagery of actual violence, death, serious injury, or cruelty to animals.

• Hate speech, incitement to violence or discrimination against protected groups, and terrorist content.

• Harassment, threats, intimidation and doxxing.

• AI-generated imagery. We do not accept non-original objects generated by a computer program within the meaning of Article 33 of the Law of Ukraine "On Copyright and Related Rights" — that is, images produced by a program without the direct participation of a natural person in creating what is depicted. Such objects are not works, attract no copyright, and you cannot grant us the licence in section 4.3 over them.

  This is not a ban on digital tools. AI-assisted editing of a photograph you took — denoising, retouching, upscaling, generative fill of a small defect, colour work — is permitted and always has been. The line is whether a human being authored the image.

• Content that is not yours to post, or that infringes anyone's intellectual property.

• Scraping, reverse engineering, or disrupting the service.

7. Moderation, enforcement and appeals

7.1 How moderation works

Moderation has two stages.

Stage one — automated. Every uploaded image is scored automatically for adult and prohibited content by our classification systems. This is a machine assessment of the image; it produces a score and a provisional status, and it may cause an image to be blurred or withheld from public surfaces pending review.

Stage two — human. No account is banned and no image is permanently removed by a machine alone. A person reviews content that automated systems flag or that users report, considers artistic context and intent, and records a written justification for every enforcement decision. Automated scores inform that decision; they do not make it.

7.2 Reporting content

If you believe content on Arteriya is illegal or breaks these rules, report it to abuse@arteriya.pro. Tell us where the content is (a link is ideal), what is wrong with it, and how to reach you.

We acknowledge every report, assess it diligently and without arbitrary distinction, and tell you what we decided.

7.3 What happens when we act

Where we remove content, restrict its visibility, or suspend or terminate an account, we give the affected user a statement of reasons containing:

• what we did — removal, restriction, suspension or termination;
• the facts and circumstances we relied on;
• the specific rule in section 6 that was breached;
• whether automated means were used in detecting or deciding the matter;
• how to challenge the decision.

7.4 Appeals

You may appeal any enforcement decision, free of charge, for six months from the date we notify you. Write to appeals@arteriya.pro setting out why you think the decision was wrong.

A person who was not involved in the original decision reviews the appeal wherever this is practicable. We will tell you the outcome and our reasons. If we were wrong, we reverse the decision and restore the content or the account.

Nothing in this section limits your right to go to court.

7.5 Repeat infringement

Accounts that repeatedly breach these rules are terminated. In particular, and reflecting Article 56 of the Law of Ukraine "On Copyright and Related Rights", two or more substantiated copyright violations concerning the same work within three months will lead to termination.

8. Copyright infringement and takedown

We respond to copyright complaints under the procedure in Article 56 of the Law of Ukraine "On Copyright and Related Rights", which binds us as a website owner and sets strict deadlines.

8.1 Making a complaint

A complaint under Article 56 is a formal application for the cessation of an infringement. Send yours to copyright@arteriya.pro. It must contain:

1. Who you are — full name, address, and contact details. If you are the rightsholder, say so; if you act for one, say for whom.
2. The work — identification of the copyrighted work you say has been infringed.
3. Your rights — a substantiated statement of your exclusive rights in that work.
4. The infringing material — a hyperlink to the specific page or image on Arteriya. A general description is not sufficient.
5. What you want — a statement that you require the infringing content to be removed or access to it disabled.
6. A statement of truthfulness — that the information you have given is accurate.

If you are a legal entity, Article 56(2) requires that your complaint be submitted through an attorney-at-law or a registered patent attorney, who certifies the truthfulness statement. Individual authors may apply directly.

8.2 What we do

Within 48 hours of receiving a compliant complaint we will either disable access to the content, or send you a reasoned refusal. Where the content belongs to a user other than the person who controls the page, we forward your complaint to them within 24 hours.

8.3 Counter-notice

If your content was removed and you believe that was wrong, you may send us a counter-notice with the same categories of information as section 8.1, explaining why your use is lawful.

Where a valid counter-notice is received, we restore access on the tenth working day, unless the original complainant provides evidence before then that they have commenced court proceedings.

8.4 Bad-faith complaints

A takedown complaint is a legal instrument. Sending one you know to be false — for example, to remove a competitor's portfolio — may expose you to liability for the resulting damage. We keep records of every complaint and every counter-notice.

8.5 United States rightsholders

Arteriya is not currently offered in the United States (section 3.2). Before opening the service there we will register a Designated Agent with the United States Copyright Office and publish a notice-and-counter-notice procedure meeting 17 U.S.C. § 512. Until then, US rightsholders should use the procedure in section 8.1, which we apply to all complaints regardless of origin.

9. Non-consensual intimate imagery

If an intimate image of you has been published on Arteriya without your consent, tell us and we will remove it within 48 hours.

This applies whether the image is authentic or a synthetic or manipulated depiction ("digital forgery"), and whether or not you have an Arteriya account.

How to make a request. Email abuse@arteriya.pro with:

1. your physical or electronic signature;
2. identification of the image, and information reasonably sufficient for us to find it (a link is best);
3. a statement, made in good faith, that the image was published without your consent;
4. your contact details.

A parent or guardian may submit on behalf of a minor; an authorised representative may submit on someone's behalf.

What we do. We acknowledge your request, give it a tracking reference, remove the image within 48 hours of validating it, and make reasonable efforts to find and remove identical copies elsewhere on the service. We then tell you what we did. We do not require you to prove the absence of consent before acting.

This procedure is deliberately separate from the general reporting route in section 7.2, and it is faster.

10. Safety features

Arteriya offers safety tools for in-person work: shoot check-ins, an emergency contact, and a silent alarm.

How escalation works. If you miss a check-in, we send you a reminder. If you miss again, we raise an alert in the application and send notification by email.

⚠️ We do not currently send SMS messages or place telephone calls. Alerts are delivered in the application and by email only. Your emergency contact will not receive a text message. We intend to add SMS escalation and will update this section when we do.

Arteriya is not an emergency service. These tools are provided on a best-effort basis. They depend on networks, devices and third-party services we do not control, and they cannot summon help. In an emergency, call 101, 102, 103 or 112. Do not rely on Arteriya as your only safety measure.

Nothing in these Terms excludes our liability for death or personal injury caused by our negligence.

How we handle your emergency contact's personal data — and the notice we give them — is described in section 7 of the Privacy Policy.

11. Paid plans

Arteriya is currently free. There are no paid plans, no subscriptions and no payment processing. Plan tiers visible in the interface are set by us and cost nothing.

Before introducing paid plans we will publish, and ask you to accept, terms covering at least: the price inclusive of taxes; the billing period and renewal; how to cancel; refund and withdrawal rights, including the 14-day distance-contract right under Article 13 of the Law of Ukraine "On Consumer Protection" and your rights under the Law of Ukraine "On Digital Content and Digital Services" (№ 3321-IX); and the tax treatment of the price.

We will not charge you anything without your express prior agreement.

12. Suspension, termination and deletion

12.1 You may leave at any time

You may stop using Arteriya and ask us to delete your account by writing to support@arteriya.pro. We are building self-service deletion; until it ships, we handle requests manually and will confirm when it is done.

What deletion does. We delete your profile, your images and their derivatives from storage, your face data, your embeddings and analysis records, your collaboration graph entries, and your authentication record.

What survives, and why. Some information necessarily remains:

• Credits and participation records held by other users. Where you were credited on someone else's project, or verified someone's participation, that record is part of their professional history. Your name may remain in it. Tell us if you want to discuss a specific record.
• Messages you sent to other people, in their copy of the conversation.
• Moderation records, for the period in section 14 of the Privacy Policy.
• Records we must keep by law, including tax records.
• Backups, until they rotate out — within 90 days.

12.2 Export your data

You may request a copy of your personal data and the content you uploaded, in a commonly used machine-readable format, free of charge. Write to us. We are building self-service export; until then we produce it manually within 30 days.

12.3 When we may suspend or terminate

We may suspend or terminate an account where: these Terms are breached, particularly section 6; we are required to by law or by a state authority; there is a serious risk to another person's safety; or the account is used fraudulently.

Except where prohibited content or a safety risk requires immediate action, we tell you first, give you the statement of reasons in section 7.3, and you may appeal under section 7.4.

We may also terminate accounts on notice during the alpha, as the service changes. If we do, we will give you a reasonable opportunity to export your work first.

13. Watermarking and provenance

Every display version of your images with a longest edge of 640 pixels or more carries an invisible, forensic watermark — a code embedded in the image data itself, imperceptible to the eye. It does not alter how your work looks.

There is no visible watermark on Arteriya. We do not stamp marks across your photographs. The invisible watermark exists so that if your work appears elsewhere, the /verify tool can establish that it originated here. The original file and the smallest thumbnail are not watermarked.

What we record when someone submits an image to that tool — and what we do not — is described in section 12 of the Privacy Policy.

14. Warranties and liability

14.1 The service is provided as it is

Arteriya is in closed alpha. It is provided "as is" and "as available", without warranty of any kind. Features may change, break or be withdrawn. Data loss, though we work to prevent it, is possible. Keep your own copies of your work — Arteriya is not a backup service.

14.2 We are not party to your engagements

Arteriya helps people find each other and organise projects. We are not a party to any agreement you reach with another user, we do not employ, vet, endorse or supervise users, and we are not responsible for anyone's conduct, on the platform or in person.

Trust indicators reflect activity recorded on Arteriya. They are not a safety guarantee, a background check or a recommendation. Use your own judgement, especially before meeting anyone in person.

14.3 Limits on our liability

To the fullest extent the law permits, we are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity, or loss of data.

Where we are liable, our total liability to you for all claims is limited to the greater of the amounts you paid us in the twelve months before the claim, or 1,000 UAH.

These limits do not apply to: death or personal injury caused by our negligence; our own fraud or wilful misconduct; gross negligence; or any liability that cannot lawfully be limited. If you are a consumer, nothing in these Terms removes rights you have under mandatory consumer-protection law, and any term that would worsen your position below that statutory minimum does not apply to you.

14.4 Your indemnity

You will indemnify us against claims, losses and reasonable costs arising from your content, your breach of these Terms, or your infringement of anyone's rights — in particular claims by people depicted in images you uploaded.

15. Governing law and disputes

These Terms are governed by the law of Ukraine. Disputes are subject to the courts of Ukraine.

If you are a consumer, this choice does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of the place where you are domiciled.

Ukrainian consumers may also address the State Service of Ukraine for Food Safety and Consumer Protection.

We would rather resolve things directly. Write to legal@arteriya.pro before starting proceedings and we will try to sort it out.

16. Changes to these Terms

We may update these Terms. When we do, we change the version number and the effective date at the top.

• For minor changes — clarifications, corrections, new provider names — we publish the new version and note the change.
• For material changes — anything affecting your rights, the licence you grant, or how we use your data — we notify you and ask you to accept the new version. Content uploaded under an earlier version stays governed by that version unless you accept the new one.

Every published version is archived. Ask us for any past version.

Language. These Terms are published in Ukrainian and in English. The Ukrainian version is the authoritative text; the English version is a translation provided for convenience. Where the two differ in meaning, the Ukrainian version prevails. Both versions are published at the same address and carry the same version number and effective date.

17. How to contact us

Each address below reaches the operator. They are separated so that time-critical reports are not queued behind general correspondence.
